TAMPA, FL — A man on probation for a 2005 DWI manslaughter charge was arrested on Oct. 29 on a new count of drinking and driving.
Lamon Eugene Allen, 37, was pulled over just before 1 a.m. around 33rd Avenue and N 29th Street after police noticed he was driving without a seat belt. The officers said they smelled alcohol on Allen’s breath and that his eyes were glassy and bloodshot. His speech was also slurred.
The officers issued Allen a field sobriety test, which showed he might be intoxicated and later gave him a breath test, which determined his blood alcohol level was at .18 percent, over twice the legal limit of .08 percent. Allen was then arrested for DWI charges.
Allen had previously served nearly four years in jail for a DWI manslaughter charge in 2005. Allen had been driving west on State Road 60 near U.S. 301 on Nov. 4 2005, when he made a left turn and crossed into the path of a motorcyclist. The victim, Leroy Anthony Mitchell, 48, was ejected from the motorcycle upon impact. He died at the scene of the accident.
At that time, Allen’s blood alcohol level was 0.11 percent. He was sentenced to five years in prison but was released in March and began a 10 year probation sentence.
