November 15th, 2012    Posted in DUI News

SAN FRANCISCO, CA – A woman with three prior DUI convictions was arrested on suspicion of driving under the influence on Thursday morning after injuring a pedestrian in San Francisco.

The suspect, Cerena Barros, 23, of San Jose, was involved in a series of DUI crashes beginning at around two in the morning. Barros drove a 2004 Jeep Cherokee onto westbound Interstate 80 at the end of the Bay Bridge using the Fourth Street on-ramp, which was closed for construction.

A California Highway Patrol officer tried to stop her, but Barros sped away and exited the freeway at the Mission Street/Van Ness Avenue off-ramp. Barros continued heading south to 15th and Natoma streets, where she crashed into a parked car, which in turn, hit victim Aaron Wells, who had been walking on the sidewalk with his bicycle. Wells suffered minor wounds to his legs and was treated at San Francisco General Hospital.

After crashing into the car, Barros continued to 17th Street and South Van Ness Avenue, where she crashed into a traffic-signal box and knocked out signals at the intersection. CHP officers finally arrested her and charged her with suspicion of felony hit-and-run, evading officers, driving under the influence, driving with a suspended license, and other charges related to controlled substances. Her blood-alcohol level was over 0.08 percent, the legal limit for operating a motor vehicle, according to CHP.

Another Athlete Busted for DUI? Yep, This Time it’s the LA Laker’s Guard Eubanks

November 9th, 2012    Posted in DUI News

Los Angeles, CA- It’s been a tough day for the Lakers. Today they fire their coach Mike Brown, and guard, Devin Eubanks has been arrested for DUI.

California Highway Patrol pulled Eubanks over around 2:45 a.m. Friday morning in the Hollywood area. He was booked into jail at 3:15 a.m., but was released after posting $5,000 bond.

The Los Angeles Times reported that Thursday, hours before his arrest Eubanks posted on his Twitter account urging people to attend a woman’s birthday party at the Roxbury. They didn’t have any other details on his arrest, other than his arraignment is scheduled for Dec. 7th.

Since the NBA team is dealing with the firing of Coach Mike Brown. Eubanks arrest has been lost in the noise, but they are aware of the situation.

Eubanks now joins the growing number of pro-athletes who have been charged with intoxicated driving. There have been so many it’s hard to keep up with.

Regardless of their status, these athletes are still subject to same penalties as anyone else, and they can jeopardize their future careers. Though given the frequency of arrests in the pro realm, teams can’t afford to take drastic actions against everyone.

Eubanks, like any one, can hire a DUI attorney to work on their case and will likely be able to stop a conviction or engineer a plea for reckless driving. When an attorney is unable to keep their client from being convicted they can at least negotiate for a lesser penalty.

Seahawks’ Marshawn Lynch May Walk Away From DUI

July 19th, 2012    Posted in DUI News

According to Seattle Seahawks running back Marshawn Lynch’s DUI lawyer, there is a very good chance that the drunk driving charges will be dropped for his client.

DUI attorney Ivan Golde said there was “better than 50 percent chance” his client was not drunk when arrested on suspicion of intoxicated driving over the weekend.

Lynch was charged with DUI Wednesday in Alameda County, Calif. Tests revealed his blood alcohol content was at .08 percent, which the state considers legally intoxicated.

However, due to fluctuations and inaccuracies with testing, Golde believes there was a chance his client was not drunk.

“There’s a better than 50 percent chance he’s .06 or .07 (in blood-alcohol content),” said Golde. “Those tests have a margin of error. Science is there to prove it.”

Golde also raised concerns regarding another blood-alcohol test that was issued. The second test, administered about 40 minutes after the first, registered a higher blood alcohol content level – .10 percent.

The California Highway Patrol defends the arrest, saying it is possible for an individual’s blood alcohol content to elevate over time depending on when they began drinking.

Regardless of what the police are contending, Golde believes the outcome of the case will be “very positive” for Lynch.
